By registering, you acknowledge that you have read, understood, and agree to all the terms, conditions, rules, and regulations stated below and anywhere else on this website.
Account Registration and Maintenance
- You certify that all the information provided during registration is truthful and accurate. You are responsible for updating and maintaining the accuracy of your registration details (e.g., phone number, address, postal code, email).
- If any information provided is deemed false by our staff or auto-verification system, your account may be suspended or removed until further verification is completed.
- You must be at least 18 years old to register on our website. By using this site, you agree to maintain the confidentiality of your account and password, restricting access to your account. You accept responsibility for all activities that occur under your account.
- We require valid government issued ID for every pickup. We reserve the right to refuse service if ID is not presented. There are no exceptions.
- We do not store, hold, copy or share customer financial information including, but not limited to, debit or credit card numbers. The only personal information we store is your name, address, email and phone number. We do not share any personal information unless required by law.
Auction Participation and Payments
- By placing a bid, you enter into a legally binding contract to purchase the item if you are the highest bidder when the auction closes.
- A 10% buyer’s premium is added to all winning bids. Effective August 2, 2026, a $1 handling fee is then applied to each item prepared for pickup. Standard Ontario 13% HST is applied after the buyer’s premium and handling fee.
- Items refused or restocked before an order is invoiced are not charged a handling fee. Handling fees are generally non-refundable once invoiced. The handling fee and applicable HST are refunded for an item only when KOTN records the refund as a picking error or not found. Other approved item refunds include the winning bid, buyer’s premium, and HST only.
- Payment methods include cash, debit, e-transfer (EMT), or credit cards (Mastercard or Visa). E-checks and prepaid credit cards are not accepted.
- If a credit card is used for any portion of a payment, an additional 2% surcharge applies to the entire pre-tax order total, including the buyer’s premium and handling fee. We highly recommend using e-transfer (EMT), debit, or cash.
- All items must be paid for and picked up by the stated deadlines. Failure to do so will result in forfeiture, account suspension, and a 15% restocking fee for defaulted invoices. Suspensions are lifted upon fees paid.
Anti-Bot Policy
- The use of bots, automation tools, or scripts to participate in auctions is strictly prohibited unless required due to a disability.
- Customers with disabilities who need automation tools to access our platform must contact us in advance to ensure compliance and accessibility support.
- Any accounts found using unauthorized automation tools will be subject to suspension or permanent removal.
Item Descriptions and Returns
- Items are sold “As-Is” unless otherwise noted. Returns for eligible items require a completed Return Authorization Form, original packaging, and adherence to return policies and deadlines.
- Descriptions are based on our observations or sourced from retail websites. We do not guarantee accuracy for retail product descriptions or MSRP values.
- It is the buyer’s responsibility to research all items before bidding. Returns for reasons such as overbidding or buyer regret will not be granted.
- Large, fragile items such as TVs require manual inspection at the time of pickup to ensure the physical condition matches our description. Refusal of this inspection will void your warranty on that item for any undocumented physical damage or damaged caused by mishandling.
Operational Policies
- Inventory originates from truckloads purchased from major retailers and shipping companies or approved consignors. Approximately 95% of listed items are owned by KOTN.
- Invoices must be paid in full before items are removed. Partial payments are not allowed. Splitting invoices is not allowed. There is no limit on number of payment types used, but if a credit card is included the 2% surcharge will apply to the entire order, including the handling fee.
- Failure to pick up items after payment deadlines will result in storage fees, restocking fees and forfeiture.
Website and Content Usage
- All content on this site (text, graphics, logos, etc.) is the property of King of the North Auction and protected under copyright laws.
- These terms and conditions may change at any time, and it is your responsibility to review them periodically.
Legal and Compliance
- All items sold are subject to applicable taxes in Ontario.
- Buyers are responsible for ensuring items comply with Canadian Consumer Product Safety Act (CCPSA) standards.
- Any disputes will waive the right to a trial by jury and may be referred to legal action or collection agencies if necessary.
Platform Integrity
- King of the North Auction reserves the right to cancel, refuse, disqualify, delete, or adjust any auction item, bidder, account, or registrant at any time without cause.
