Terms of Sale

All registration information the Bidder provides shall be current, complete, and accurate.

All Bidders must be 18 years of age or older. Any interference with the auction in any way by a Bidder will result in his or her removal from the building.

All sales are subject to 13% HST (Harmonized Sales Tax). If you are exempt from paying sales tax you must provide the Auctioneer a copy of your license or fill out a tax exemption form.

All items are subject to a 10% Buyer’s Premium on top of the winning bid. The 13% HST is then added to that amount (e.g.: $20 winning bid + $2 10% premium = $22 + 13% sales tax = $24.86 total).

Nothing is removed from the premises until the Buyer’s invoice is paid in full.

The Buyer acknowledges and agrees they can’t retract their bid after the item has sold. All sales are final once sold.

The Highest Bidder shall be the Buyer, and if any dispute arises during the sale, then the Auctioneer may, at his discretion, put the Lot up again. The Auctioneer’s decision is final.

The Auctioneer reserves the right to accept or reject any bid and shall control the bidding at all times.

There are NO hidden reserves on any items up for auction. If there is a reserve, it will be announced.

Buyer is aware of removal time and is responsible for making all arrangements for merchandise removal during day of auction. Buyer must bring their own “man power” for moving items.

There is a $5 a day per item storage fee for all items that can’t be removed the day of the auction and therefore must be stored to accommodate a later pickup date for the Buyer. This balance must be paid at time of removal. Max storage time is 14 days from day of auction. Once passed the item is forfeited back to the auction house and will be resold as a consignment for that Bidder at a rate of 75% hammer price at the next auction.

Items have been displayed and each Buyer shall be held responsible to have observed the item and be satisfied with the condition, identity and authenticity, and shall not be permitted to make any objections after the sale on any grounds whatsoever.

Despite efforts to avoid withdrawal of item/lots from the sale it may sometimes be necessary. Auctioneer and the Owner/Seller reserve the right to do so at any time before or during the sale.

Merchandise becomes the full responsibility of the Buyer at time of PAYMENT. Buyer shall be at his own risk and liability at the Owner’s property for pick ups or for anyone picking up on their behalf, and shall hold the Owner/Seller and the Auctioneer harmless for the Buyer’s negligence. Buyer shall also be held responsible for any damage to the Owner’s property, caused by the Buyer.

The Auctioneer gathers information about Bidders and Owners/Sellers for the purposes of verifying the Buyer’s identity in case of fraud or theft. Auctioneer does not, and will not, sell or rent this information.

As a Bidder you are responsible for any bids placed under your bidding number. You will be held accountable for any items won.

There are NO BUYER REMORSE RETURNS allowed (e.g.: my wife doesn’t like the colour; I decided I do not need the item).

We offer a very generous 14 day warranty policy with full refund (meaning a manufacturer malfunction, missing parts, damage) that was not indicated at time of auction. We no longer hold any responsibility to that item regardless of situation once this period has passed. There is no warranty for any customer negligence use of an item or damage caused by the Buyer.

Any items/lots stated AS-IS during the auction are final sale with no warranty.
